     Andrew R. Schulman is an experienced New Hampshire attorney who specializes in complex civil and criminal litigation.  He focuses his civil practice on cases involving medium sized businesses and closely held companies. 

 

     -Andy has represented many companies involved in disputes over intellectual property such as trademarks, copyrights and trade secrets.  Andy has also helped companies enforce contractual nondisclosure and non-competition agreements to protect their intellectual property and goodwill.

 

     -Andy has represented a number of closely held companies involved in disputes with their shareholders or other insiders.  In one case, Andy represented a company that specialized in precision components for the medical device industry against a  shareholder/competitor.  Each side claimed that the other misappropriated trade secrets, breached their fiduciary duties and violated a series of contractual agreements.  Ultimately the case was settled by our adversary agreeing to relinquish his shares and our client agreeing not to manufacture certain products.

 

-Andy handles a wide variety of contractual disputes.  For example, Andy recently concluded a jury trial concerning the contractual and common law duties of group benefits insurance brokers and their customers.

 

-Andy routinely represents businesses involved in disputes with municipalities and the state.  Andy challenged the legality and constitutionality of the Town of Salem's sewer assessment scheme on behalf of a commercial real estate development company.  The town requires owners of new construction to pay substantially more than existing water and sewer ratepayers. The case settled prior to trial.

 

-In another case, Andy represented a company that wished to construct a telecommunications tower in southern New Hampshire.  The town land use authorities denied the necessary permitting and Andy filed suit in U.S. District Court under the federal Telecommunications Act.  The court remanded the case for a second hearing before the town board which once again denied a permit.   The federal court eventually found that the town's actions did not violate federal law and the U.S. Court of Appeals affirmed.

 

-Andy successfully defended a New Hampshire company that leases gasoline stations and convenience stores against a claim by one of its tenants that the federal Petroleum Marketing Practices Act applied to their commercial relationship.

 

-Andy was one of a number of attorneys who represented a Catholic religious order and private school in several civil clergy sexual abuse cases.  

 

-Andy represented an internet based investigation agency that provided information about a young woman to a stalker who killed her. This civil lawsuit received national attention due to several issues of first impression. The case involved complicated questions of personal jurisdiction, privacy law, consumer law and statutory interpretation.  

 

-Andy defended a large car dealership against several claims of defamation and infliction of emotional distress.  The dealership inadvertently published an offensive newspaper advertisement that related to several employees.  The case raised interesting questions about the constitutional limits of defamation law and the interplay between the tort system and the workers' compensation system.

 

-Andy successfully represented a county prosecutor and department of corrections in a federal civil rights action brought by a former pretrial detainee who claimed he was unlawfully arrested and prosecuted and subjected to unfair treatment while detained.
